Directors of AspinallVerdi have involved in a number of regeneration and infrastructure schemes throughout England where local authorities and government bodies have implemented CPO powers.

Whether you are a private landowner looking to sell a development site or a developer/public body assembling a major regeneration scheme we have a range of services which can add value.

Site Disposal

We can extract the maximum value from land for our landowner clients when selling as part of a redevelopment scheme. This includes the preparation of development briefs, obtaining planning permission and marketing the site.

Site Acquisition & Assembly

We hold relevant experience in valuation and negotiation in order to achieve an agreement by private treaty for the purchase of development sites. Acquisition by private treaty including overage and/or development agreements and/or joint ventures is always preferable to compulsory purchase.

Compulsory Purchase

We can advise acquiring authorities on strategy and process including: initial feasibility studies; statement of reasons; statement of case; statement of evidence; and expert witness at inquiry. We can also act for those affected by a CPO by navigating the complex negotiations relating to compensation.

Valuation and Compensation

We are experienced in providing valuation advice and negotiating compensation within the CPO regime including equivalent reinstatement.

Regeneration Projects

In many regeneration projects, such as Wakefield Waterfront, Bath City Centre and Rugby Town Centre we have helped local authorities deliver regeneration strategies by advising on masterplans, viability, planning and site assembly. We have prepared schedules of values and compensation working alongside land referencing companies and we have prepared Statements of Reason / Statements of Case. We prepared a Strategic Sites Assembly Strategy for Northumberland County Council to implement the Blyth Town Centre Masterplan; and we have advised on the potential for CPO as a mechanism for land value capture for the St Cuthbert’s Garden Community a comprising 10,000 dwellings.

In many cases CPO powers are not used but remain “in the background” with site acquisition being agreed by negotiation.

Infrastructure Projects

Similarly, we have acted for landowners such as Chevin Housing, Salts Healthcare to negotiate compensation for land taken. We acted for Chevin Housing in respect of the Sheffield Bus Rapid Transit scheme and we are acting for Salts Healthcare in respect of HS2 in Birmingham. This usually involves valuing the property and compiling the Particulars of Claim alongside your solicitors. Note that professional fees are usually recoverable as part of the claim.

We have successfully undertaken valuations and negotiations for both developers and occupiers where premises have been acquired by compulsory purchase.
